Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hot work operations performed in areas which were not made fire safe and contained the presence of flammable vapors: a) Monro Muffler & Brake Service / 2187 West 12th Street, Erie, PA/Area in and around Bays #3 and #4: On or about March 17, 2012, a torch utilized in Bay #3 ignited flammable vapors produced by vehicle fuel system work taking place in Bay #4. In Bay #4, the vehicle fuel system work included but was not limited to a vehicle's fuel tank being lowered to allow personnel service the fuel pump. The condition exposed personnel to fire hazards and related burn injuries. Abatement Note: Among other methods, feasible and acceptable means to correct the condition include: A. Conducting a hazard analysis to determine which vehicle fuel system servicing/maintenance operations can produce flammable vapors in sufficient quantities to pose a fire/explosion hazard. B. Establishing and implementing written procedures that: 1.) Identify the bays/work areas where vehicle fuel tank and fuel pump operations will be performed during the work day. 2.) Communicate to workers the location in the shop/work area where vehicle fuel tank/fuel pump work will be taking place. 3.) Relocating the vehicle fuel tank/fuel pump operations to a section of the shop where ignition sources can be effectively be controlled. 4.) Prevent hot work operations and/or other ignition sources from entering the section of the shop where gasoline tank/fuel pump operations are being performed. C. Train personnel on the written procedures. Utilize the requirements noted in NFPA 51B - Fire Prevention During Welding, Cutting, and Other Hot Work to facilitate the training
