Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that they were exposed to struck-by hazards. a) Construction site, 83 Alexander Avenue, Montclair, NJ Employees used a motorized RGC 250G Platform Hoist to hoist materials up to the roof were exposed to struck by hazards. The platform hoist these employees used was not installed correctly prior to use. The track was assembled from one 16 foot section and two 8 foot sections. These sections were not secured together correctly with splice plates and four nuts and carriage bolts on each side of the track. The hoist track was also damaged in three locations with broken cross ties. The wire rope was not reeved around its drum, and loose. In addition, the track was used without the track support assembly at rung 13 as required by the manufacturer for a track length greater than 28 feet. Among other abatement methods, one feasible and acceptable method of abatement is to follow all manufacturer requirements for installation and use, including, but not limited to, 1) Insure all structural members of the hoist are free of defects and damage that may affect the integrity of the hoist; 2) Connect sections of the track together as required by the manufacturer with the correct splice plates and bolts and hex nuts; 3) Reeve the wire rope around the drum properly to avoid kinking and damage to the wire rope, and 4) ensure that the track support has been properly installed for track lengths over 28 feet.
