Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a) At the employer's facility in Williamsport, PA: The Caterpillar model 80 forklift was not equipped with a seatbelt exposing operators to a crushing hazard in the event of a roll-over, on or about January, 10, 2012. b) At the employer's facility in Williamsport, PA: The Caterpillar model V200 forklift was not equipped with a seatbelt exposing the operator to a crushing hazard in the event of a roll-over, on or about January 10, 2012. c) At the employer's facility in Williamsport, PA: The Hyster model 155 forklift was operated without the use of the installed seatbelt exposing the operator to a crushing hazard in the event of a roll-over, on or about January 10, 2012. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED Among other methods, one feasible and acceptable method of abatement for this violation is to: 1) Purchase and install proper operator restraints on each forklift that is not equipped with an operator restrain system. (Retro-fit seat belts are available for the V200 from the manufacturer). 2) Instruct each operator in the proper use of the operator restraint system. 3) Ensure that supervisors enforce the requirement for operators to use the seatbelt at all times while operating the forklift.
