Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards from standing on the top cap and/or top step
of an eight foot plastic
portable step ladder:
a) Jobsite: Client cottages, attic access, 111 Elwyn Road - On or about
4/13/2012, employees
were exposed to a fall of eight feet while climbing on the top cap/and or
top step of a portable
plastic step ladder used to access the attics in clients' cottages through
a ceiling opening for
performance of normal work requirements such as the regular maintenance of
the HVAC system.
The employer did not provide a safe means to access the attics.
Among other methods, feasible means of abatement are to comply with the
American National
Standards Institute (ANSI) standard A14.5, 2007, Ladders - Portable
Plastic
Reinforced - Safety
Requirements, 9.3.2, "The user shall not step or stand on a ladder top cap
and the top step of
a step ladder" or to provide a ladder or stairs compliant with OSHA
standards.
Abatement certification required within 10 days after abatement date. The
certification
shall include a statement that abatement is complete, date and method of
abatement, and
states employees and their representatives were informed of this
abatement.tives
