Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to employees employment and a place of employment which were free
from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees. Employees were exposed to the hazard of being crushed by a
tipped/overturned
articulated boom truck crane while operating the crane and/or working
with/near the crane.
a)North side of building, on the street in front of jobsite:
Employees were exposed to being caught and crushed between the articulated
boom truck and the ground, and between the crane boom and the building,
while using the crane to load supplies into the building. The crane's
outriggers
were not fully extended for stability prior to use. The Crane
manufacturer's
instruction for safe use of the crane was not followed. On or about
08/18/11.
Among other methods, one feasible and acceptable method to correct this
hazard is:
Comply with the manufacturer's manual for articulated boom truck crane -
FASSI Model 390SE.24, pages 3 & 7
Page 3 - "Remember that the stability of the unit (crane-vehicle) is only
guaranteed by the fully lateral extension of the outriggers."
Page 7 - "INSTRUCTION FOR CRANE USE", and manufacturer' safety
plate label DE2676 - "INSTRUCTIONS FOR SAFE USE OF THE CRANE",
which both state: Step 5 "Stabilize the vehicle by the outrigger rams,
making
sure that the lateral supports are fully extended."
NOTE:  IN ADDITION TO CERTIFICATION OF ABATEMENT, THE
EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF
ABATEMENT FOR THIS ITEM.  FAILURE TO COMPLY MAY RESULT IN
AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
