Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: Employees were exposed to severe crushing injuries in the event of rollovers when operating a forklift in the warehouse and hammer room without using the equipped seat belt. Feasible and acceptable methods for abating this violation include employer enforcement of a policy requiring seat belts to be worn by employees at all times when operating forklifts and periodic review of operations.
