Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impalement and cut hazards: (a)Throughout the construction site: On October 6, 2011 and at times prior to; Concrete form pins were not guarded and employees were exposed to hazards associated with impalement and cut hazards by falling onto uncapped forming pins while engaged in construction and carpentry work. Among other methods, feasible and acceptable methods to correct this hazard would include: Installing caps over the top of the forming pins or provide barricading in the area to prevent employees from entering the area and being exposed to the hazard.
