Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about October 19, 2011 and times prior thereto, employees of Fig Tree, Inc. were operating powered industrial trucks throughout the Main Shop. Employees did not wear seatbelts while operating the forklifts and the employer did not require the use of seatbelts. Employees were potentially exposed to death in the event of a forklift tip-over.
