Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing or physical harm from collapsing storage racks and/or falling materials due to damage caused by industrial lift/fork trucks and/or the materials stored above them: a)Warehouse/Storage racks Aisle B: Three facility storage racks containing materials were unstable. Racks were missing anchor bolts. Racks were found to have braces that were either bent or broken. Facility racks were also found to have broken, bent, damaged and/or missing uprights. Condition observed on or about 10/20/11. b)Warehouse/Storage racks Aisle C: Two facility storage racks containing materials were unstable. Racks were missing anchor bolts. Racks were found to have braces that were either bent or broken. Facility racks were also found to have broken, bent, damaged and/or missing uprights. Condition observed on or about 10/20/11. As identified in ANSI MH16.1-1974 1.4.8: bottom portions of posts shall be protected from collisions..upon such damage the pertinent portion of the rack shall be immediately unloaded...repaired or replaced. Among other methods, feasible and acceptable methods to correct this hazard includes, but is not limited to the following: 1. Replace damaged sections of racks. 2. Repair damaged sections of racks using approved practices. 3. Place anchor bolts at the feet of the storage racks. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
