Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the potential hazard of fire and explosion:
(a)Land O' Lakes, Inc. - The Nu-Con dust collection system, serial number
N99069-680, that was used to collect milk powder from the powder bag room,
was located inside the building and did not have an explosion prevention
system
designed in accordance to NFPA 69, Standard on Explosion Prevention
Systems,
on or about September 14, 2011.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD INCLUDES FOLLOWING NFPA 61, STANDARD
FOR THE PREVENTION OF FIRES AND DUST EXPLOSIONS IN AGRICULTURAL AND
FOOD PROCESSING FACILITIES(2002 EDITION), INCLUDING BUT NOT LIMITED TO
: LOCATE THE DUST COLLECTOR OUTSIDE OF THE BUILDING, PROTECT THE
EQUIPMENT BY CONTAINMENT, SUPPRESSION, INERTING OR EXPLOSION
VENTING. VENTING SHALL BE DIRECTED TO A SAFE, OUTSIDE LOCATION AWAY
FROM PLATFORMS, MEANS OF EGRESS OR OTHER POTENTIALLY OCCUPIED
AREAS.
Abatement certification required within 10 days after abatement date. The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.
