Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls, slips, or trip hazards at the unloading/loading operation because of the inadequate light levels: (a)Curtis Bay Energy, Incorporated - The employees unloading the local pick-up trucks and transferring the medical waste and sharps to the trailer were provided with 3 footcandles of light from battery powered lantern(s) and this level was not adequate to protect employees from tripping hazards, on or about November 29, 2011. Among other methods, one feasible and acceptable method to correct this hazard is to follow the guidelines noted in the American National Standards Institute (ANSI) Recommended Practice for Lighting Industrial Facilities (RP-7-01), Figure A2-2, page 59. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
