Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:11/14/11 Location:West Side of Job Site Condition:The swing radius of a Hitachi Excavator, Model EX 230LC, being used to install water service into the earth, was not barricaded. Among other methods, one feasible and acceptable method to correct this hazard is to erect a barricade around the swing radius of the superstructure of this equipment to prevent employees from being struck or crushed by it.shed
