Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall/tip over hazards:
a)On or about October 13, 2011 and times prior throughout the facility: The
employer failed to ensure a company fabricated man basket was certified
for use
with the Komatsu 18 and Thompson AT19C00794 forklifts to ensure capacity,
stability and safe operation was not effected exposing employees to fall /
tip over
hazards.
Among others, one feasible and acceptable method to correct the hazard is
to have the
man basket certified and make appropriate changes to the capacity plate(s)
as needed in
accordance with generally recognized consensus standards such a American
National
Standards Institute (ANSI) B56.1 Safety Standard for Low Lift and High
Lift Trucks.
