Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by/crushed by: a) 372 Route 24, Chester, NJ The operator of the 2007 Dodge Ram 3500 moved the vehicle without having visual contact with his employee. The employee was on the rear of the vehicle, unlatching the tailgate when the operator backed the vehicle into a tree, crushing the employees' right leg between the back of the vehicle and the tree. Violation occurred on or about 11/4/11. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1. Prior to moving the vehicle in any direction, the operator must be able to see all of the employees that are involved in the operation in order to confirm that no employee is in the path of the moving vehicle.
