North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed by or struck by hazard: a)warehouse/ granite slab area- where on or about September 28, 2011, an employee operated a Kalmar AC LPG fork lift (model E437056) equipped with a roll over protection system (ROPS) without a seatbelt. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees wear their seat belts and comply with the American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks (forklifts), ASME B56-1-2000, paragraph 5.3.19.
