North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by an automobile falling off the lift due to the removal of locking arms: a)garage-two Precision Metal Works automobile lifts each equipped with four swing arms to support automobiles being serviced, had the locking bars removed and had been modified without the written permission of the manufacturer. (ref para 7.1.3 American National Standard B153.1-1990) One feasible means of abatement is to obtain and reinstall the proper locking arms in accordance with the manufacturers requirements.
