North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to being crushed and/or struck by mechanized
equipment.
a) Sweet potato warehouse packing and storing operation, located at 2775
Hockaday Road, Four Oaks NC-
Powered industrial trucks operators had been operating mechanized
equipment without the benefit of adequate
training. Employees had received formal training, where they were shown a
forklift video, but were not given
practical training or evaluated in their performance. In addition, two
employees were operating a Yale model #
MPW060LEN24T2780 walkie powered pallet truck without the benefit of
training.
Abatement Notice: One feasible and acceptable means of abatements is to
develop and implement a training
program that follows the requirements of the operation manual for each
powered industrial truck to which
employees will be assigned to operate. The training should be a
combination of  formal instruction,  practical
training, and evaluation in the performance of the equipment.e

serious physical harm to employees, in
that employees were exposed to falling hazards and to be struck and/or
crushed
by a pallet truck.
a) Work site located at 2775 Hockaday Road, Four Oaks, NC- Two employees
were loading sweet potato
boxes into a 18-wheeler semi, tractor-trailer with the help of a Yale
model # MPW060LEN24T2780 walkie
powered pallet truck, where the walking/working surface was elevated 4
feet above a cement floor and no
measures were implemented to prevent the employees nor the equipment from
falling.
Abatement Notice: Various feasible and acceptable means of abatement
includes:
1. Construct a permanent loading dock with a guarded ramp that connects
the floor of the tractor trailer with
the surface of the loading dock, eliminating the height of 4 feet between
the tractor trailer and the concrete
ground.
2. Provide a portable steel loading yard ramp that connects the rear end
of the tractor trailer with the surface
of the building floor.
3. Provide the employees with a portable industrial truck ladder that
facilitate
the access from and to the
platform were they are working.
