North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by or caught between hazards: a)Fabrication and production area of the facility - The horn was not functioning on the "TCM" forklift, model #FG15-N2, serial #2576031, capacity 1500 lbs, and the lift was available for use. b)Fabrication and production area of the facility - The rear turn/brake light of the "Komatsu" forklift, model #FG25-8, serial #133984, capacity 5500 lbs, was broken and had duct tape wrapped around it and the lift was available for use. c)Fabrication and production area of the facility - The back-up alarm was not functioning on the "TCM" forklift, model #FG15-N2, serial #2576031, capacity 1500 lbs, and the lift was available for use. d)Fabrication and production area of the facility - The back-up alarm was not functioning on the "Komatsu" forklift, model #FG25-8, serial #133984, capacity 5500 lbs, and the lift was available for use.
