North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to fall hazards:
a)Lot 12, Angier Industrial Park - where a commercially designed and
constructed metal work
platform attached with a piece of chain that had been wrapped around the
work rest on the left
side of the SKY TRAK 6036 Extendible Boom Rough Terrain Forklift was held
in place with a
piece of soft iron wire.
b)Lot 12, Angier Industrial Park - where a commercially designed and
constructed metal work
platform attached with a piece of chain that had been loosely wrapped
around the work rest on
the right side of the SKY TRAK 6036 Extendible Boom Rough Terrain Forklift
was not
secured to any point.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to secure the
platform with appropriate chains, clevises, or other securing devices
before lifting personnel.
Reference: ASME B56.6-1992, Paragraph 5.15.1, "A rough terrain forklift
truck should not be used to lift
people unless there is no other practical option.  If a rough terrain
forklift truck must be used to lift people, the
following precautions for the protection of personnel shall be taken: (b)
Be certain that the platform is securely
attached to the lifting carriage or forks."
c)Lot 12, Angier Industrial Park - where the operational capacity of a
commercially designed and
constructed metal work platform had not been identified and the employer
provided it for use
with the SKY TRAK 6036 Extendible Boom Rough Terrain Forklift.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to use
appropriately designed personnel lifting equipment such as scissors-lift
type
vehicles or bucket trucks.

forklift truck must be used to lift people, the
following precautions for the protection of personnel shall be taken: (t)
The combined mass (weight) of the
platform, load, and personnel shall not exceed one-third of the capacity
at the related load center position as
indicted on the information plate(s) of the rough terrain forklift truck
on which the platform is used."
d)Lot 12, Angier Industrial Park - where an employee working from the
commercially designed
and constructed metal work platform which was elevated to approximately
12-feet above packed
earth with the SKY TRAK 6036 Extendible Boom Rough Terrain Forklift
climbed over the
guardrails of the platform to return to the ground level.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to use
appropriately designed personnel lifting equipment such as scissors-lift
type vehicles or bucket trucks.

Personnel are to maintain firm footing
on the platform floor unless secured by body belt and lanyard.  Use of
railings, planks, ladders, etc.,on the
platform for the purpose of achieving additional reach or height is
prohibited. (w) Platform shall be lowered to
floor level for personnel to enter and exit.  Personnel shall not climb on
any part of the rough terrain forklift
truck in attempting to enter or exit."
