North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushed by hazards: a)Westpark Apartment complex - where the an employee operated a TEREX TX760B Back-hoe in the driving mode with another employee sitting on the fender. Abatement Note: Among others, one feasible and reasonable method of abatement would be train employees to only ride on machines where there is available seating. Reference: Association of Equipment Manufacturers' Safety Manual for Operating and Maintenance Personnel: "WARNING: YOUR BACKHOE/LOADER IS A ONE-PERSON MACHINE. NEVER PERMIT RIDERS."
