North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to being caught in machinery:
a)loading dock area-access to the operating area of a Republic stationary
trash compactor was
not guarded by an appropriate method to prevent employee injury while the
machine was in
operation (RE: para5.9.1 (a)-(c) ANSI Z245.2-2008) .
One feasible means of abatement is to install a gate to prevent employees
from walking onto
the machine while in operation.
OR IN THE ALTERNATIVE:
29CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways,
platforms, or
runways above or adjacent to dangerous equipment, pickling or galvanizing
tanks, degreasing
units, and similar hazards shall be guarded with standard guardrail and
toe board.ail
