North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by and crushed by hazards: a)301 Barcelona Dr., Bld 28 - where the seat belts installed on two GRADALL 524D rough terrain forklifts were unserviceable in that the buckles would not fasten. Abatement note: One reasonable and feasible method of abatement would be for the employer to repair or replace unserviceable seat belts. REFERENCE: American National Standards Institute B56.6-1992, Safety Standards for Rough Terrain Forklift Trucks, Paragraph 6.2.1: "Before starting to operate the rough terrain forklift truck: (a) be in operating position and fasten seat belt, if so equipped:" and Paragraph 6.5.1.1 "If the rough terrain forklift truck is found to be in need of repair or is in any way unsafe, or if it contributes to an unsafe condition, the matter shall be reported to the user's designated authority, and the truck shall not be operated until it has been restored to safe operating condition."
