North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling hazards: a)facility, employer failed to ensure that employees were not lifting personnel on the forks of the forklift. One feasible and acceptable method of abatement, among others, to correct this hazard is for the employer to provided a specially designed work platform that is accepted by the forklift manufacturer according to Caterpillar Operation & Maintenance Manual.ance
