Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by and/or crushed-by hazards: (a)On or about September 16, 2011 - Facility, the employer did not equip a Toyota Forklift with an operator restraint system. Among other methods, one feasible and acceptable method to correct this hazard would be to install an operator restraint system approved by the powered industrial truck manufacturer.
