Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed amputation hazards: a)Production: The Niagara press brake was not provided with a guard and the employer had not implemented a safe distance program, observed on or about 10/26/11. ABATEMENT NOTE: One feasible and acceptable means of abatement would be for the employer to establish and implement a safe distance program that conforms to the requirements of ANSI B11.3-1982 paragraph 6.1.4.3 and provide the required training elements listed in the OSHA Directive CPL 2-1.25. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
