Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that employees were exposed to crushing hazards: a) Throughout facility: Employees were exposed to crushing hazards when stocking and picking from racking units that had such damage as, but not limited to, dented, twisted or missing braces, on or about 10/28/11. One feasible and useful method of abatement would be to follow the Rack Manufacturers Institute Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks 2002 section 1.4.9 Rack Damage, which requires the user to immediately unload damaged portions of the rack and replace or adequately repair. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
