Nevada Revised Statute 618.375(1): Duties of employers. Every employer shall furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his or her employees. At the V Theater, in the Miracle Mile Shops, an employee who worked from a Genie aerial work platform to change light bulbs was exposed to possible serious injuries or death from falls from the platform and from the equipment tipping over. A top rail section (opposite the entrance-side) of the platform's guardrail system had been cut out, exposing the employee to fall hazards. The platform can reach heights up to 24 feet. The lift was also used without the outriggers which are required to stabilize the lift prior to elevating the platform. Working from the elevated platform without the outriggers exposed the employee to possible serious injuries or death in the event it tipped over. Only three of the four required outriggers were available, but none were used. One feasible means of abatement would be to follow the requirements of the manufacturer's Operating Instruction Manual. "Do Not Operate Unless: You inspect the entire machine for possible damage and test all machine functions for proper operation." Page 2. "Tip-over And Fall Hazard. Do not elevate platform unless all four outriggers are properly installed, leveling jacks firmly contact floor, and base is level." Pre-operation Inspection & Function Tests Page 7. "Repair any machine damage or malfunctions before operating machine."
