Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
was free from
recognized hazards that were causing or likely to cause death or serious
harm to employees in
that the employer did not insure that portable fire extinguishers were
continuously maintained
and subjected to periodic maintenance checks.
Cage house-An extinguisher had not been inspected in more that 7 years.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to establish a maintenance and testing program that complies with the
National Fire Protection
Association (NFPA) Life Safety Code 101 paragraph 4.6.13.
Abatement certification is required for this violation. The abatement
certification sheet is
enclosed with the citations.

The employer did not furnish employment and a place of employment which

recognized hazards that were causing or likely to cause death or serious
harm to employees
in that the employer did not ensure that each powered industrial truck
operator was
competent to operate a powered industrial truck safely.
Cage houses-None of the employees who drove forklifts had received
training and had not
been properly evaluated by the employer.  There was evidence that an
unprotected charging
unit had been struck by a forklift.
Among other methods, feasible and acceptable methods to abate this hazard
are as follows;
1. Establish the elements of a comprehensive training and evaluation
program as described in
ANSI B56.1-2005 section 4.18.
2. Establish a dedicated area in which the charging unit is protected from
being struck as
described in National Fire Protection Association (NFPA) 505 4-3.2.
Abatement certification is required for this violation. The abatement
certification sheet is
enclosed with the citations.
