North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevation: a)jobsite, Fairway Row, employees were being lifted, 6 to 8 feet off the ground, on a pallet attached to the forks of a Harlo rough terrain forklift. Abatement Note: Among other methods, one feasible method to correct this hazard is to follow the requirements set forth in The American Society of Mechanical Engineers (ASME) B56.2-2002, Safety Standard for Rough Terrain Forklift Trucks, Section 5.15, Elevating Personnel.
