50-9-5.A NMSA 1978, The New Mexico Occupational Health and Safety Act:
The employer
did not furnish to each of his employees employment and a place of
employment which are free
from recognized hazards that are causing or are likely to cause death or
serious physical harm
to his employees:
Employees working from and below the Rio Puerco Bridge were exposed to
severe crushing and struck by injuries in the event of bridge collapse
during
removal operations.  The employer failed ensure that structural members
were
adequately secured during removal of the bridge deck slab, resulting in
girder
buckling and collapse with employees present.
Slab removal procedures, developed by a professional bridge engineer in
1990 as
noted in the 'AS BUILT' drawings for the Rio Puerco Bridge, were available
to
the employer but were not fully utilized to include girder stabilization.
Feasible and acceptable methods of abatement may include:
a.Follow the 1990 deck slab removal procedures developed by the bridge
engineer, including leaving slab sections in place over girders during
slab removal
and/or;
b.Ensure that employees are not present in areas which may be adversely
affected when demolition operations are being performed, including
locations
beneath structural members.
