Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: Employees working in the cabinet shop located at 111 E. Main, Cherryvale, KS 67335 were exposed to fire and explosion hazards for the following conditions: a)The dust collectors were located inside the building for the following 5 instances: 1) Dust Technology Inc. model DF100 dust collector, serial #9909814, attached to the thickness sander and the planer located in the middle of the shop. 2) Grizzly Industrial Inc. model G0548 dust collector, serial #01420 attached to the table saw located in the southeast corner of the shop. 3) Grizzly Industrial Inc. model 50548 dust collector, serial #014292 attached to the two panel saws located along the west wall of the shop. 4) Grizzly Industrial Inc. model G0548 dust collector, serial #014209 attached to the shapers in the northwest area of the shop. 5) Grizzly Industrial Inc. model G0548 dust collector, serial #014294 located at the northwest corner of the shop. b)The exhaust from the dust collectors was not discharged outside. Among other feasible and acceptable methods to correct these hazards are to follow NFPA 664 Prevention of Fire and Dust Explosions in Wood Processing and Woodworking Facilities, 2007 Edition including, move the dust collector outside as per Section 8.2.2.5.14. "Where and explosion hazard exists and ensure the exhaust is vented outside as per Section 8.2.2.6 "Exhaust air from the final air-material separator shall be discharged outside unless provisions 8.2.2.6.1, 8.2.2.6.2, 8.2.2.6.3, or 8.2.2.6.4 are met. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
