Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a)On or about November 21, 2011 - Bay 2, Polishing Department, the hook on the CM Model W hoist did not have a safety latch installed. Among other methods, one feasible and acceptable method to correct this hazard would be to comply with the requirements of the American Society of Mechanical Engineers Standard ASME B30.10-1993, Hooks, Section 10-1.1.2(b), install a safety latch and establish an inspection program to ensure the equipment is properly maintained.
