Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to: A fall hazard of 10-feet
8-inches.
a) South west side of building: An employee power washing the exterior of
a building
as well as cleaning and polishing windows from a two point powered
suspended scaffold
platform, 10-feet 8-inched above ground level, had not been provided
training in the
proper use of all fall protection equipment provided him by the employer.
Among other methods, feasible and acceptable methods to correct the
hazardous
condition may include: Provide fall protection and hazard awareness
training to
employees prior to exposing them to fall hazards. Additionally, follow the
requirements
of the American Society of Mechanical Engineers standard and the
International Window
Cleaning Association publication IWCA I -14.1 - 2001

a) Southwest side of building: The five eights of an inch, synthetic rope
lifelines were
for two employees working from a suspended swing stage scaffold 10-feet
8-inches above
ground level were resting directly on the sharp edges of a parapet wall
where they could
have received damage through abrasion.
Among other methods, feasible and acceptable methods to correct the
hazardous
condition may include: These hazardous conditions could be eliminated by
placing a
padded barrier between the lifeline and the edges of the parapet wall.
Also following the
requirements of the International Window Cleaning Association publication
IWCA I -14.1
- 2001 which was approved by the American National Standards Institute on
October 25,
2001 would reduce the risk.
