North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to struck by/caught by hazards:
a)within the facility, maintenance shop, a seat belt was
not provided on the Nissan Forklift, Model YGF03A40TV,
Serial Number YGF03-001741.
Among other methods, one feasible method to abate the
hazard is to retro-fit the lift with a seatbelt.
NOTE:  In 1993, Nissan Forklift initiated retro-fit
restraint seat procedures.
