Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by the anchorage point of the
roll off container:
a)  1307 84th Street, North Bergen, NJ
A 10 yard roll off container was being winched up onto a tilt frame truck
when
the anchorage point of the container broke off and was propelled through
the rear
window of the truck cab, fatally striking the operator.
Violation occurred on or about 12/3/11.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is

In accordance with ANSI Z245.1 - 2008, Mobile Wastes and Recyclable
Materials Collection,
Transportation, and Compaction Equipment-Safety Requirements, Section 9:
1.  In regards to the loading of roll off containers, the employer must
evaluate and manage
safety issues related to the operation of mobile collection equipment.
2.  Develop a safety program to manage safety issues related to the
operation of mobile
collection equipment, which must include a hazard assessment, an
evaluation of the means and
methods of controlling the hazards identified in the hazard assessment, a
written program to
include procedures for the operation, inspection and maintenance of
equipment, prohibited
practices, record keeping, training requirements, and normative references
to documents, such
as operating manuals.
3.  Ensure all employees, including supervisors and contract laborers, are
properly
trained for
their assigned jobs, tasks and use of related equipment.
