Labor and Employment Article, Section 5-104(a): The employer did not furnish emp loyment and a place of employment which were free from recognized hazards that w ere causing or likely to cause death or serious physical harm to employees: (a)D ate of Violation:12/10/11 Location:Warehouse Condition:Employees were exposed to flour dust explosion, deflagration, or other fire hazards where: an approximate ly 12 foot by 12 foot by 20 foot fixed, fabric silo capable of containing 70,000 pounds of flour was not equipped with explosion relief venting; the silo and pn eumatic conveying system were not bonded and grounded; air from within the silo was discharged back into the plant without first being cleaned. Among other meth ods, one feasible and acceptable method of abatement includes complying with Nat ional Fire Protection Association 61 Standard for the Prevention of Fires and Du st Explosions in Agricultural and Food Processing Facilities which would include but would not be limited to: cons tructing silos according to local, state, and national codes; providing for expl osion relief venting; filtering displaced air that is discharged back into the b uilding; ensuring that all system components are electrically conductive and tha t electrical continuity is maintained throughout the system. Abatement documenta tion (photographs, receipts, copies of programs, training certification, etc.) i s required for this item.
