Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:10/26/11 Location:Production Room Equipment:Aerocon Aero Mechanical Conveyor Condition:Employees were exposed to dust explosion, deflagration, or other fire hazards when operating equipment used to convey combustible dusts and incompatible materials, such as potassium bromate and organic powders, when the conveying system was not grounded, was not properly maintained, and was not equipped with any type of explosion suppression or explosion venting. (b)Date of Violation:10/26/11 Location:Production Room Equipment:AGET Dustkop and Mistkop, Model 20T30, Serial #1901 Condition:Employees were exposed to dust explosion, deflagration, or other fire hazards where an enclosureless dust collector was located in the work area and was not effectively bonded and grounded, and was not equipped with any type of explosion suppression or explosion venting. Among other methods, one feasible and acceptable method of abatement includes performing a process hazard analysis/assessment on the Aerocon Aero Mechanical Conveyor system and the dust collection system, and obtaining certifications verifying that the design, installation, operation and maintenance of the systems meet all applicable standards including, but not limited to, National Fire Protection Association Standards 61 (Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities) and 654 (Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids). Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.

Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:10/26/11 Location:Warehouse Condition:Employees were exposed to fire and explosion hazards due to two 110 pound containers of potassium bromate which is a strong oxidizer high hazard material stored on a wooden pallet directly next to other organic powders and combustibles including, but not limited to, a container of beta carotene powder. Among other methods, one feasible and acceptable method to abate the hazard is to relocate the two 110 pound containers of potassium bromate, which is a strong oxidizer, DOT Haz Class 5.1 to an isolated storage via fire-rated cutoff walls or detached storage structure. Certification verifying the design, installation, operation of potassium bromate product storage met all applicable standards including, but not limited to, National Fire Protection Code, Standard 430, Storage of Liquid and Solid Oxidizers, 2004. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
