Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) Newark, NJ A Helper mounted the front step of Truck #37 and rode on the step while the truck backed up. Violation occurred on or about 1/9/12 at approximately 4:30 am. b) Corner of Osborne Terrace and Nye Avenue, Newark, NJ A Helper attempted to mount the front step of Truck #37 while the truck was in motion. Violation occurred on or about 1/9/12 at approximately 5:30 am. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1. Enforce safety rules during the route, such as not riding on the truck while it is in reverse, not riding on steps designated as access steps only, and not mouting a moving vehicle.
