Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees
in that
employees were exposed to struck-by hazards:
a. On or about February 01, 2012, the employer failed to ensure that an
anti-repeat
feature was used on a Cincinnati 2510 mechanical sheer used in a single
stroke operation.
When employees used the sheer to cut steel plate using a single stroke the
sheer cycled
repeatedly when the foot control was pressed. This condition exposed
employees to
struck-by hazards.
b. On or about February 01, 2012, the employer failed to ensure that the
foot control on
a Cincinnati 2510 mechanical sheer was protected to prevent unintended
actuation. This
condition exposed employees to struck-by hazards.
Among other methods, one feasible and acceptable means of abatement would
be to
follow the requirements found in the American National Standard Institute
(ANSI) B11.4
2003 edition, Safety Requirements for Shears. Section 6.3.3.1 requires:
"When
mechanical and hydraulic shears are used in single-stroke operations, they
shall
incorporate an anti-repeat feature." Section 6.3.3.3 requires: "Foot
operated controls, if
provided, shall be protected to prevent actuation from falling or moving
objects, or from
unintended actuation by unintended stepping onto the foot control."
