North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: a)jobsite, on November 8, 2011, an employee was observed riding on the elevated forks of a skid steer while working to unload trees. Among other methods, one feasible and acceptable abatement method includes, Follow the Association of Equipment Manufacturer's (AEM) Manual for users and operators of skid steer loaders which states, "Never use the bucket, forks or other attachments for a work platform or personnel carrier," and "No riders allowed."
