Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:12/15/11 Location:Production Plant, Parsons Warehouse Condition:Employees were exposed to crushed by/struck by hazards from collapsing steel storage racks that were accessed by a forklift and were not adequately secured to the floor. (b)Date of Violation:12/16/11 Location:Garage Condition:Employees were exposed to crushed by/struck by hazards from collapsing steel storage racks that were accessed by a forklift and were not adequately secured to the floor. Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with ANSI MH16.1:2008, 1.4.7 Specification for the Design, Testing, and Utilization of Industrial Racks. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.

Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:On or About 12/13/11 Location:Boiler Room Condition:The plumbed eyewash did not provide sufficient water flow when actuated where employees were exposed to caustic soda liquid and Diethylaminoethanol(FTS-81), both corrosives, while treating water. Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with the American National Standard for Emergency Eyewash and Shower Equipment, ANSI Z358-1998. That prior to the date of issuance hereof, Kelly Foods Corporation Violated the standard, regulation, or section of the MOSH Act cited herein, for which the following citation(s) was/were issued and became final: 1. Item No. 24, of Citation No. 1 of Case No. F3659-023- 09, issued on 01/28/2009, resulting from an inspection at 10313 Old Ocean City Boulevard, Berlin, MD 21811 and became final on 02/20/2009.
