HAR 12-60-2(a)(3)  was violated because:
The employer failed to protect employees exposed to fall hazards while
performing job-
related duties on a wooden pallet elevated approximately 20 feet above
ground by a HYSTER
forklift.  Employees were allowed to pull orders from upper storage racks
in the frozen
storage warehouse without a proper cage or platform designed for that
purpose.
ANSI/ITSDF B56.1:2012 Safety Standard for Low Lift and High Lift Trucks,
Section 4.17.3
states "Whenever a truck is equipped with a work platform (does not
include operator-up
high lift trucks), precautions specified in para. 4.17.2 shall be taken
and the following
additional precautions shall be taken for the protection of personnel:
(a) Provide a platform
that complies with the design requirements in para. 7.37.3."
12-60-2(a)(3) states "Every employer shall provide safe work places and
practices by
elimination or reduction of existing or potential hazards.  Elimination of
existing
or potential
hazards by design, process substitution, or other appropriate methods is
preferred because it
eliminates the need for further employee protection.  When elimination is
not feasible,
reduction of existing or potential hazards to acceptable levels, using
methods such as
engineering or administrative controls, isolation, or guarding, shall be
promptly used.  When
these methods are inadequate to reach acceptable levels, personal
protective equipment shall
be provided and used."
