HAR 12-60-2(a)(3) was violated because:
The employer failed to protect employees exposed to fall hazards while
performing job-
related duties on a wooden pallet elevated approximately 20 feet above
ground by a YALE
forklift.  Employees pulled orders from upper storage racks in the frozen
storage warehouse
without a proper cage or platform designed for that purpose and properly
secured to the
forklift.  ANSI/ITSDF B56.1:2012 Safety Standard for Low Lift and High
Lift Trucks,
Section 4.17.3 states "Whenever a truck is equipped with a work platform
(does not include
operator-up high lift trucks), precautions specified in para. 4.17.2 shall
be taken and the
following additional precautions shall be taken for the protection of
personnel: (a) Provide a
platform that complies with the design requirements in para. 7.37.3."
12-60-2(a)(3)  states "Every employer shall provide safe work places and
practices by
elimination or reduction of existing or potential hazards."
