Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious phyical harm to employees
in that employees
were exposed to the hazard of:
The employer does not ensure that employees wear safety belts while
operating forklifts. The
violation was observed in the plantermill. The employees were moving
banded lumber to a
storage area. This exposed the employees to a crushing hazard.
Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the date of
this citation, the
employer must submit documentation describing the actions it is taking to
establish,
communicate, and implement written procedures to ensure that employees
wear safety belts
while operating the forklifts.
Among other feasible methods to correct the identified hazard, one method
would
be to ensure
that employees use the installed seat belts on the forklifts to eliminate
the hazard of entrapment
of the operator's head and/or torso between the truck and the ground in
the event of a tip over.
This hazard is identified in paragraph 7.41 of ANSI/ITSDF B56.1-2009 which
also requires
counterbalanced, center control, high lift trucks that have a sit-down,
nonelevating operator
position to have a restraint device, system or enclosure for this
purpose.e
