Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to the hazard of potential fires and explosions: (a)On or about March 6, 2012 - Facility, an inspection and maintenance program was not developed and implemented to ensure that fire and explosion protective systems and process controls (such as, but not limited to, dust control equipment) performed as designed; and production equipment (such as, but not limited to, milling machines) were not maintained and operated to minimize the escape of combustible dust during normal operation. (b)On or about March 6, 2012 - Mixing and All-fill Departments, dust collection systems were not installed in areas where combustible dust is used and generated in order to minimize the escape and accumulation of dust. Among other methods, one feasible and acceptable method to correct this hazard would be to comply with the National Fire Protection Agency (NFPA) 664 Standard for the Prevention of Fire and Dust Explosions in Wood Processing and Woodworking Facilities, 2007.
