Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling from height: a) for the employee(s) trimming palm tree branches located at 3555 SR 60 E Mulberry (FL), as observed on or about 01/24/2012. An employee was working from a wooden pallet which had been elevated with the forks of a Hyster RC150 forklift. The employee was exposed to a fall hazard of eight feet. Abatement Note(s): Among other methods, means of feasible and acceptable abatement includes but may not be limited to: 1. Use of a manufacturer's approved working platform designed for elevating employees which is compliant with ANSI/ITSDF B56.1-2005 guidelines; 2. Use of ladder(s); and/or, 3. Use of pole saws designed for tree trimming.
