Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 02/03/12, at 541 Lincoln Drive, Miami Beach, FL, an employee was struck by a load of building material being placed into position on a second floor balcony by a rough terrain forklift. Among other methods, one feasible and acceptable abatement method to correct the hazard is to have employees to stay in plain view of rough terrain forklift operators at all times while the material is being moved and to follow Section 6 (Operating Safety Rules and Practices) of the ANSI/ITSDF B56.6-2005. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
