Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or were likely
to cause death or
serious physical harm to employees in that employees were exposed to
struck by hazards, while
performing warehouse work.
On or about 03/01/2012, at 2975 Horseshoe Dr. South, Naples, Fl., the
employees were
exposed to struck by hazards, while performing work in the warehouse. The
employer failed to
ensure that storage rack structural components were maintained properly in
that the racks were
not secured, anchored to the floor, and there was no load capacity
placard.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is
to secure the racks, and to anchor them to the floor.
