Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 04/27/12 at 2261 NW 66th Avenue Miami, FL 33122. An employee operating a forklift was not wearing a seat belt. Employees were exposed to tip over hazards and being crushed by the forklift. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to keep forklift operators from operating forklifts without using seatbelts.
