North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion: a)metal fabricating area, Donaldson Torit Downflo DFT 2-4 dry-type dust collector utilized for combustible metal dust, such as, but not limited to: aluminum and steel; was located inside the building. b)metal fabricating area, Donaldson Torit Downflo DFT 2-4 dry-type dust collector utilized for combustible metal dust, such as, but not limited to: aluminum and steel; was not provided with deflagration vents. c)metal fabricating area, Donaldson Torit Downflo DFT 2-4 dry-type dust collector utilized for combustible metal dust, such as, but not limited to: aluminum and steel; dust collection system was not dedicated for collection of only aluminum dust. d)metal fabricating area, Donaldson Torit Downflo DFT 2-4 dry-type dust collector utilized for combustible metal dust, such as, but not limited to: aluminum and steel; dust was not removed from the collector at least once each day. e)metal fabricating area, the employer did not develop a program to control and minimize hazards associated with combustible metal dust, such as, but not limited to: fire prevention, fire protection, and emergency response. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to comply with the National Fire Protection Agency (NFPA) 484, "Standard for Combustible Metals" (2009/2012). Additional abatement methods include, but not limited to: 1-Relocate dust collector outside the building. 2-Install deflagration vents on dust collector. 3-Install separate dust collectors to separate aluminum from other dusts. 4-Establish cleaning program and remove dust from the collector at least once per day. 5-Develop procedures to include an inspection, testing, and maintenance program to control and minimize the hazards associated with combustible metal dusts; develop and train employees on emergency preparedness procedures for combustible metals.
